The Ministry of Investment, Trade and Industry (MITI) announced that effective immediately, all exports, transshipments, and transits of high-performance AI chips of US origin are subject to a Strategic Trade Permit. This requirement follows Section 12 of the Strategic Trade Act 2010 (STA 2010), specifically the Catch-All Control provision, which mandates notification to the relevant authority at least 30 days prior to export, transshipment, or transit if there is knowledge or reasonable suspicion that the item could be misused or used for restricted activities.
This measure aims to address regulatory gaps as Malaysia reviews the inclusion of high-performance AI chips of US origin in the Strategic Items List (SIL) under STA 2010. Malaysia emphasizes its commitment to preventing the circumvention of export controls and illicit trade activities. Strict legal action will be taken against any individual or company violating the STA 2010 or related laws.
While supporting investments and trade that align with international best practices and multilaterally agreed commitments, all entities in Malaysia are required to comply with applicable international obligations to prevent any secondary sanctions on their operations. MITI remains dedicated to maintaining a secure, transparent, and rules-based trading environment with trade partners and will not tolerate any misuse of Malaysia’s jurisdiction for illegal trading.
