Re:
By its action under Article 263 TFEU, the applicant seeks, primarily, the annulment of Decision A-002-2022 of the Board of Appeal of the European Union Agency for the Cooperation of Energy Regulators (ACER) of 9 December 2022 dismissing as inadmissible the appeal brought by the applicant against ACER Decision No 03/2022 of 25 February 2022 on the amendment to the methodology for pricing balancing energy and cross-zonal capacity used for the exchange of balancing energy or operating the imbalance netting process, in so far as, in that decision, ACER had set, for a period of 48 months from 1 July 2022, a price limit up to which suppliers of balancing energy, such as the applicant, could exchange that energy on the European platforms PICASSO and MARI, and, in the alternative, the annulment of the initial decision.

Operative part of the judgment:
1. Dismisses the action;
2. Orders RWE Supply & Trading GmbH to pay the costs.
